This Acceptable Use Policy ("AUP") applies to anyone who uses https://www.avprimedesign.com, a Smart Tap device or dashboard, our customer portal, or any other AV Prime Design Corp. ("AV Prime," "we," "us," or "our") service. It is incorporated by reference into your Service Agreement and, where applicable, your Smart Tap Terms. We may suspend or terminate access for conduct that violates this AUP, consistent with the termination provisions of your Service Agreement.
1. General Rules
You agree not to use our services to:
- Violate any applicable law or regulation, or facilitate someone else doing so.
- Infringe or misappropriate another party's intellectual property, privacy, or publicity rights.
- Transmit malware, attempt to gain unauthorized access to any system, or otherwise interfere with or disrupt the integrity or performance of our services or anyone else's.
- Harass, threaten, defraud, or deceive any person.
- Impersonate any person or business, or misrepresent your affiliation with one.
- Send unsolicited bulk communications in violation of applicable law (including the rules described in your Smart Tap Terms and Privacy Policy for SMS and marketing consent).
2. Content Responsibility
You are responsible for the content you submit, upload, configure, or direct through our services — including text, images, destination links, AI prompts and configuration, and anything your Smart Tap device is configured to show or say. We do not pre-screen most content, but we may remove or disable content that we reasonably believe violates this AUP, applicable law, or a third party's rights.
3. Prohibited Smart Tap Configurations
In addition to the rules in Section 1, you may not configure a Smart Tap device, AI feature, or destination page to do any of the following: direct people to unlawful, fraudulent, or deceptive content; collect personal information beyond what your Privacy Policy and applicable law allow; fabricate, alter, gate, or incentivize reviews in violation of the review platform's own policies or applicable law; or present an AI feature as a human where disclosure of automation is legally required and has not been enabled. 4. Security Testing
You may not probe, scan, or test the vulnerability of our systems or a Smart Tap device without our prior written permission, except to the extent applicable law expressly permits such activity despite this restriction.
5. Resale & Unauthorized Access
You may not resell, sublicense, or provide access to our services to anyone not authorized under your agreement with us, or attempt to access another client's account, data, or Smart Tap devices.
6. Reporting a Violation
If you believe someone is misusing our services or a Smart Tap device, contact us at info@avprimedesign.com.
7. Enforcement
We may investigate suspected violations of this AUP and take action we consider appropriate, which may include removing content, disabling a feature or device, suspending an account, or terminating service consistent with your Service Agreement. We are not obligated to take any particular action and may act without advance notice where we reasonably believe it is necessary to protect our systems, other clients, or the public.
8. Changes to This Policy
We may update this AUP by posting a revised version with a new effective date.
